Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Privacy Policy:

• Account means a unique account created for You to access Our Websites or parts of Our Websites.
• Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.

• Consumer refers to every individual who is in the USA for other than a temporary or transitory purpose, and every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.
• Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.
• Device means any device that can access Our Websites such as a computer, a cellphone or a digital tablet.
• Do Not Track (DNT) is a concept that has been promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission (FTC), for the internet industry to develop and implement a mechanism for allowing internet users to control the tracking of their online activities across websites.
• Personal Information is any information that relates to an identified or identifiable individual. Personal Information means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.
• Sensitive Personal Information is information that identifies, relates to or could reasonably be linked with You or Your household. For example, it can include social security numbers, driver’s license, state ID card or passport number, account log-in, financial account number together with any security code that allows access to an account, geolocation, racial or ethnic origin, or union membership, genetic data, biometric information, health or sexual orientation.
• Service Provider means any natural or legal person who processes the data on behalf of the Company. It also refers to third-party companies or individuals employed by the Company to facilitate, provide and perform the Services on behalf of the Company and to assist the Company in analyzing how the Services are utilized.
• Third-Party Social Media Service refers to any website or any social network website or any mobile app through which a user can log in or create an account to use the Websites.
• Usage Data refers to data collected automatically, either generated by the use of the Websites or from the Websites infrastructure itself (for example, the duration of a page visit).
• Websites refers to the Mariani Premier Group website, accessible from https://marianipremiergroup.com/ and any other website, including social media site or mobile app, that directs You to this Privacy Policy on the Mariani Premier Group website. • You means the individual accessing or using the Websites, or the company, or other legal entity on behalf of which such individual is accessing or using the Websites, as applicable.

Collecting & Using Your Personal Information

Types of Data Collected

– Personal Information While using Our Websites or inquiring about or engaging us to perform Services, We may collect certain personally identifiable information that can be used to contact, market to or identify You. Personally identifiable information may include, but is not limited to:

• Email address
• First name and last name

• Address, State, Province, ZIP/Postal code, City
• Banking account and credit/debit card information

– Usage Data Usage Data is collected automatically when using the Websites. Usage Data may include information such as Your Device’s internet protocol address (e.g. IP address), browser type, browser version, the pages of Our Websites that You visit, the time and date of Your visit, the time spent on those pages, geo-location data, unique device identifiers and other diagnostic data.

When You access the Websites by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data. We may also collect information that Your browser sends whenever You visit Our Websites or when You access the Websites by or through a mobile device.

– Information from Third-Party Social Media Services If You decide to register through or otherwise grant Us access to a Third-Party Social Media Service, such as Google, Facebook, Twitter (now, X) or LinkedIn, We may collect Personal Information that is already associated with Your Third-Party Social Media Service’s account, such as Your name, Your email address, Your activities or Your contact list associated with that account.

You may also have the option of sharing additional information with the Company through Your Third-Party Social Media Service’s account. If You choose to provide such information and Personal Information, during registration or otherwise, You are giving the Company permission to use, share, and store it in a manner consistent with this Privacy Policy.

Tracking Technologies & Cookies

We use Cookies and similar tracking technologies to track the activity on Our Websites and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze Our Websites. The technologies We use may include:

We do not sell Your personally identifiable information as that term is commonly understood and only use such information for the following purposes: (1) performing Services or offering products or services similar or related to the Services; (2) detecting security incidents; (3) resisting malicious, deceptive or illegal actions; (4) ensuring the physical safety of individuals; or (5) for marketing and advertising purposes; (6) performing or providing internal business services.

Retention & Transfer of Your Personal Information

Retention of Your Personal Information

The Company will retain Your Personal Information so long as is needed for the purposes set out in this Privacy Policy or a related and compatible purpose consistent with the average consumer’s expectation and to comply with applicable laws and regulations. The Company may use certain remarketing services to advertise to You after You accessed or visited Our Websites or have engaged or interacted with Our Services. We and Our third-party vendors use cookies and non-cookie technologies to help Us recognize Your Device and understand how You use Our Websites so that We can improve Our Websites to reflect Your interests and serve You advertisements that are likely to be of more interest to You.

Usage, Performance and Miscellaneous

We may use third-party Service Providers to provide better improvement of Our Websites. For example, we use an invisible captcha service named reCAPTCHA, operated by Google, which may collect information from You and Your Device for security purposes in accordance with Google’s Privacy Policy.

Additional California Privacy Rights

Our Websites does not respond to Do Not Track signals. Under California’s “Shine the Light” law, California residents with an established business relationship with Us can request information once a year about sharing their Personal Information with third parties for direct marketing purposes. California residents under 18 who are registered users may also request removal of content they have publicly posted, per California Business and Professions Code Section 22581.
